For 50 years, the name “Mayerson” has been synonymous with principled attorneys zealously representing wrongfully injured victims with integrity, compassion, and dedication. First through The Mayerson Law Offices, located at the historic Meeting House in Spring City, and now through Mayerson Injury Law, within sight of the storied Sunnybrook Ballroom, two generations of Mayersons have obtained rightful compensation for victims of injury throughout Montgomery County, Chester County, Berks County, and the surrounding areas since 1963.
Hy Mayerson began practicing in 1963 at 2 Penn Center in Center City Philadelphia, eventually expanding to locations throughout the Philly-Metro Area. The Mayerson Law Office earned a national reputation for filing the first class action on behalf of Vietnam War veterans suffering brain tumors, various cancers, post-traumatic stress disorder (PTSD), lobotomies, and other debilitating or terminal conditions due to exposure to dioxin contained in the defoliant “Agent Orange.” See Pamela Weintraub, The Agent Orange Mystery, OMNI, August 1982, at 14.
Hy was one of the filing attorneys for the first Agent Orange class action filed in the Commonwealth of Pennsylvania seeking compensation from the manufacturers of the substance for the harm it caused. He remained integrally involved in the ongoing Multi-District Litigation (MDL), In re Agent Orange Products Liability Litigation, in the United States District Court for the Eastern District of New York, successfully obtaining compensation for U.S. Military personnel suffering from dioxin poisoning.
Throughout the 1980s and 1990s, The Mayerson Law Office was the national leader in products liability litigation relating to roll-over risk and faulty or insufficient driver restraint systems in industrial forklifts. Hy’s work in this area was so notable that he was recognized for his contributions in American Jurisprudence, Proof of Facts 3d. After years of publishing on the danger of forklift rollover, the National Safety Council awarded Hy Mayerson a Certificate of Merit for his contribution to forklift safety. Hy’s success in the area of forklift products liability was such that attorneys throughout the nation sought him out to assist them on similar cases.
In 1994, Hy’s son, Benjamin, was admitted to the bar of the Commonwealth of Pennsylvania and joined the Mayerson Law Offices. Not long thereafter, he accepted a case on behalf of a Reading area couple who were struggling with their insurance company to have their car repaired following a collision. While many law firms would have turned the case down due to the limited damages, Ben, Hy, and Attorney Margaret Connors, took up the cause, eventually leading to one of the largest insurance bad faith verdicts in the history of Pennsylvania and the nation, a 21 million dollar verdict against insurer Nationwide Mutual.
The Court based its decision upon “Defendant’s unfounded refusal to pay a valid claim because it was not economically advantageous to it, the risk of harm to Plaintiffs and the public by allowing a structurally unsound vehicle to be operated and travelling on public roads, and the tremendous obstacles, including concealment of evidence, erected by Defendant.” Berg v. Nationwide Mut. Ins. Co., No. 98-813 (Berks C.C.P. June 12, 2014) (Sprecher, J.) (Verdict). While the case is ongoing, facing a second trip up Pennsylvania’s appellate ladder, it has already made waves throughout the legal and insurance industries and has forced insurance companies to be more responsible to their insureds.
